Terms and Conditions – The Adventure Institute

Effective for Pilot: 2025 | Early Access: 2026 | Full Launch: Summer 2026

The Adventure Institute, a DBA of Tam Global Ventures LLC. (“Company,” “we,” or “us”) provides access to information through our website (the “Site”) and may provide certain functionalities of the Site or services of various kinds (the “Services”). The Site and Services are available only under the following terms and conditions (the “Terms”).

PLEASE READ THESE TERMS CAREFULLY. BY USING THE SITE OR SERVICES, YOU ACKNOWLEDGE AND REPRESENT THAT:

  1. YOU HAVE READ THESE TERMS,
  2. YOU UNDERSTAND THEM,
  3. YOU AGREE TO BE BOUND BY THEM, AND
  4. YOU ARE AT LEAST 18 YEARS OLD.

If you do not agree to any of these terms, we are unwilling to grant you access to the Site or Services.

I. ACCESS TO OUR ONLINE SERVICES AND TOOLS

A. Accounts

To use certain features of the Site or Services, you must register for an account (“Account”) and provide truthful and accurate information. You are responsible for maintaining the confidentiality of your login information and all activities that occur under your Account. Notify us immediately of any unauthorized use.

BAccess to Features of Online Services

We grant you a limited, non-exclusive, nontransferable personal license to access and use the Site and Services, including any downloadable tools (“Downloadable Tools”) specifically identified on the Site.

C. General Restrictions on Use

You may use the Site and Services only for personal, non-commercial purposes. You may not rent, transfer, assign, resell, or sublicense access. You may not modify, reverse engineer, or create derivative works of the Site, Services, or Downloadable Tools. Unauthorized use, including high-volume automated access or interference with our systems, is prohibited.

D. Use of Third-Party Offerings

Links on our Site may direct you to third-party websites or services (“Third-Party Offerings”). We are not responsible for these offerings, and your use of them is subject to their terms.

E. Ownership

We and our vendors retain all rights, title, and interest in the Site, Services, and Downloadable Tools. Feedback you provide to us is non-confidential, and we may use it freely.

II. USER CONTENT

A. User Content

“User Content” includes all information or content you submit to or use with the Site or Services. You are solely responsible for your User Content, which must comply with our Acceptable Use Policy.

B. License

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your content in connection with the Site, Services, and Company marketing materials.

C. Acceptable Use Policy

You may not use the Site or Services to submit content that:

  • Violates any third-party rights;
  • Is unlawful, harmful, or offensive;
  • Harms minors;
  • Contains viruses, malware, or unauthorized advertising.

D. Enforcement

We may review and remove User Content or terminate Accounts for violations of the Acceptable Use Policy.

E. Other Users and Release

We are not responsible for interactions or disputes between users. By using the Site or Services, you release us from any liability arising from other users’ actions.

III. TERMS AND CONDITIONS OF SALE

A. Product Disclaimers

Products are not intended for children under three years. We are not liable for claims arising from improper use.

Some Adventure Institute activities encourage exploration in outdoor or natural environments. Outdoor play involves inherent risks, including uneven terrain, weather conditions, water, and natural materials. By participating, users acknowledge and accept these risks.

Parents, guardians, or caretakers are solely responsible for supervising children during outdoor activities and for ensuring a safe and suitable environment. The Adventure Institute is not responsible for any injuries, damages, or losses arising from participation in outdoor activities or use of materials in outdoor settings.

B. Products and Pricing

Product descriptions and prices are subject to change. We may cancel or modify orders due to errors or supply issues.

C. Orders

Submitting an order is an offer to purchase, subject to our acceptance. Orders are confirmed only when we send shipping information.

D. Payment Terms

You agree to pay all applicable Product prices, delivery fees, and taxes. Subscriptions will auto-renew until terminated by you. Non-payment may incur late fees and collection costs.

E. Shipping Policy

Products are shipped using the method selected at checkout. Delivery dates are estimates.

F. Cancellation Policy

  • Pilot 2025 and Early Access 2026 subscriptions may be canceled as described on the Site.
  • Subscriptions with multi-month auto-renewals cannot be canceled mid-term.

G. Return Policy

  • Certain subscription products, bulk purchases, and “Final Sale” items are non-returnable.
  • Damaged products may be returned for a full refund following the Site’s return procedures.

H. Promotions

Special offers, coupons, and discounts are subject to their official rules and may not be combined.

IV. DISCLAIMERS, LIMITATIONS AND EXCLUSIONS OF LIABILITY

A. Limited Warranties

Site, Services, Downloadable Tools, and Products are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law.

B. Limitation of Liability

Our liability to you is limited to the greater of $50 or the amounts you have paid in the prior six months. We are not liable for indirect, incidental, or consequential damages.

C. Exclusions

Certain statutory consumer rights may not be affected.

D. Indemnification

You agree to indemnify us for damages, claims, or expenses resulting from your violation of these Terms or applicable law.

  1. TERM AND TERMINATION

These Terms become effective when you use the Site, provide information, or indicate agreement. We may terminate your Account and access at any time. Certain sections survive termination, including I.C, I.D, I.E, II, III.A, IV, VI, and VII.

V. COPYRIGHT POLICY

We respect intellectual property rights and comply with copyright law. If you believe your copyright is infringed, provide a written notification including your contact information, signature, and details of the copyrighted work.

VII. MISCELLANEOUS MATTERS

A. Arbitration Agreement; Class Waiver; Waiver of Trial by Jury

All disputes shall be resolved by binding arbitration under the Federal Arbitration Act, with a class action waiver. Small claims court is allowed for individual actions.

B. Governing Law

Washington State law governs these Terms.

C. Modifications to Terms

We may change these Terms with notice on the Site or by email. Continued use indicates acceptance of changes.

D. Modifications to Services

We may modify or discontinue Services at any time without liability, except as expressly set forth in Section V.

E. General Terms

You agree to comply with all applicable laws. These Terms constitute the entire agreement between you and the Company.

VIII. PILOT AND EARLY ACCESS PROGRAMS (2025–2026)

  • The Adventure Institute will pilot select Services in 2025, with early access beginning in 2026 and full launch in Summer 2026.
  • Features, pricing, and availability during pilot and early access may differ from full launch.
  • Participants in pilot/early access programs agree to provide feedback and acknowledge that Services are experimental.
  • All other Terms and Conditions remain in effect unless explicitly modified in this section.
